I paid for a trademark to be filed and paid extra for research if any other trademarks were similar. We ended up having to abandon our application because someone had already filed for our trademark for the same class codes. The company should of found this when they did a search. Unfortunately it was 6 months later when we received notice from the USPTO that someone else had filed for the same trademark 6 months prior to ours. This should of been discovered if they actually did a search. After spending over $750, we filed a complaint with the CA BBB. The company ignored the complaint and did not address the issue nor did they ever communicate with us again. Not only did we lose the fees paid to the USPTO but also the time had passed for us to file a complaint with our credit card provider. Be very careful as a company can make claims or guarantees but when the process takes over a year to receive your trademark, good luck trying to get them to honor their promises.
